Bellwether Intel Terms of Service
Provided by Bellwether Intel, LLC. Effective date: August 18, 2026. Last updated: August 18, 2026. See the Addendum for any later changes.
1. Eligibility and Accounts
These Terms of Service (the "Terms") govern your access to and use of the Bellwether Intel website, applications, and related services (together, the "Service"), provided by Bellwether Intel LLC, a California limited liability company (the "Company," "we," "us," or "our"). By creating an account, clicking to accept, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
You must be at least 18 years old and able to form a binding contract to use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms, and references to "you" include that organization.
You are responsible for the accuracy of the information you provide, for keeping your login credentials confidential, and for all activity that occurs under your account. Notify us promptly of any unauthorized use.
2. The Service and License to Use It
Subject to these Terms and your payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable right to access and use the Service for your internal business purposes during your subscription term.
Your internal business purposes include using the Service to produce work for your own clients and customers, and publishing or otherwise using Outputs outside your organization, subject to Section 6 and Section 7. Providing your clients with deliverables you create using the Service is permitted. Reselling access to the Service itself, or providing accounts or logins to third parties, is not, except under a separate written reseller, affiliate, or white label agreement with us.
We may update, improve, or modify the Service over time. We may also add, change, or remove features, provided we do not materially reduce the core functionality of a paid plan during a term you have already paid for.
3. Subscriptions, Fees, and Billing
Paid plans are offered on a subscription basis. By selecting a paid plan, you authorize us and our payment processor to charge the applicable fees, including recurring charges, to your designated payment method.
If a payment fails, we may suspend or limit your access until amounts due are paid. You are responsible for any costs of collection on overdue amounts.
4. Free Trials and Beta Features
We may offer free trials or pre-release, beta, or evaluation features. These are provided on an as-is basis, may be changed or withdrawn at any time, and may be subject to additional terms.
If you begin a paid subscription following a free trial, we will tell you before the trial ends when the trial expires, what you will be charged, and how to cancel. Unless you cancel before the trial ends, your paid subscription will begin automatically and your payment method will be charged.
5. Your Data and Content
As between you and us, you retain all rights in the data, materials, and content you submit to the Service ("Customer Data"). You grant us a worldwide, non-exclusive license to host, process, transmit, display, and use Customer Data solely to provide, secure, support, and improve the Service and as otherwise permitted in these Terms and our Privacy Policy.
You are responsible for Customer Data and for having the rights and permissions needed to submit it. You represent that your Customer Data and its use with the Service do not violate any law or third-party right. You are responsible for obtaining any consents required before submitting personal information about any individual to the Service.
We may generate aggregated or de-identified data derived from use of the Service that does not identify you or any individual, and we may use that data for any lawful business purpose, including to operate and improve our products.
6. AI Outputs
The Service uses artificial intelligence models to generate analyses, scores, recommendations, strategies, content, and other materials (together, "Outputs").
You own the Outputs generated for your account through your use of the Service, subject to your payment of applicable fees and your compliance with these Terms.
We assign to you whatever rights we may hold in those Outputs, excluding the Service itself, our underlying software, models, prompts, templates, methodologies, and any pre-existing or generally applicable material incorporated into an Output.
You acknowledge that Outputs are generated probabilistically, that similar or identical Outputs may be generated for other users, and that we make no representation that any Output is original, non-infringing, accurate, or suitable for your purposes. You are responsible for reviewing Outputs before relying on or publishing them, and for confirming that their use complies with applicable law, platform rules, and third-party rights.
We do not use your Customer Data or your Outputs to train generalized artificial intelligence models except where you have separately opted in. We use third-party model providers to generate Outputs, and their handling of the content you submit is governed by their own terms, which vary by provider and by plan. If you have questions about the providers used for a particular feature, contact us through our contact form.
contact form7. Acceptable Use
You agree not to, and not to permit others to:
We may suspend access without notice if we reasonably believe your use poses a security risk, may harm us or others, or violates these Terms.
8. Intellectual Property
The Service, including all software, models, designs, text, graphics, and the Bellwether Intel name and marks, and all related intellectual property, is owned by the Company or its licensors and is protected by law. Except for the limited rights expressly granted to you, no rights are granted to you by implication or otherwise.
If you provide suggestions or feedback, you grant us a perpetual, irrevocable, royalty-free license to use it without restriction or obligation to you.
9. Third-Party Services and Subprocessors
The Service may interoperate with or link to third-party products and services that we do not control. Your use of those services is governed by their terms, and we are not responsible for them.
We use third-party service providers, including cloud hosting, data storage, analytics, payment processing, and artificial intelligence model providers, to operate the Service. These providers may process Customer Data on our behalf and are bound by obligations consistent with these Terms and our Privacy Policy. We remain responsible for their performance of the Service.
If you connect a third-party account to the Service, you authorize us to access and use that account as needed to provide the Service, and you are responsible for complying with that provider's terms.
10. Confidentiality
Each party may access non-public information of the other. The receiving party will use the disclosing party's confidential information only to perform under these Terms and will protect it using at least reasonable care. This does not apply to information that is public through no fault of the receiving party, independently developed, or rightfully received from a third party.
11. Disclaimers
The Service is provided on an as-is and as-available basis. To the fullest extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any analysis, score, recommendation, or Output will be accurate or suitable for your purposes.
Outputs are provided for informational purposes and are not professional advice. Nothing in the Service constitutes legal, financial, tax, medical, or other professional advice, and you should consult a qualified professional before acting on any Output.
12. Limitation of Liability
To the fullest extent permitted by law, neither party will be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill, arising out of or relating to these Terms or the Service. This exclusion does not apply to your obligations to pay fees or to your indemnification obligations under Section 13.
Our total liability for all claims relating to the Service will not exceed the greater of the amounts you paid to us for the Service in the twelve months before the event giving rise to the claim, or one hundred dollars. These limits apply even if a remedy fails of its essential purpose.
Nothing in these Terms limits liability that cannot be limited under applicable law.
13. Indemnification
You will defend, indemnify, and hold harmless the Company and its officers, employees, and agents from any third-party claims, damages, and costs, including reasonable legal fees, arising from your Customer Data, your use of the Service, or your breach of these Terms.
14. Term and Termination
These Terms apply while you use the Service. You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, fail to pay, or if we are required to do so by law. On termination, your right to use the Service ends. Sections that by their nature should survive, including fees owed, ownership of Outputs, intellectual property, disclaimers, limitation of liability, indemnification, and governing law, will survive.
You are responsible for retrieving or saving any Customer Data you wish to keep before your access ends. Following termination, we may delete Customer Data in accordance with our Privacy Policy and retention practices.
15. Copyright Complaints
We respect the intellectual property rights of others. If you believe material available through the Service infringes a copyright you own or control, send a written notice through our contact form including:
We may remove or disable access to material claimed to be infringing and may terminate the accounts of repeat infringers.
16. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will provide reasonable notice, for example by posting the updated Terms with a new effective date or by email. Your continued use of the Service after the changes take effect means you accept the updated Terms.
17. Governing Law and Disputes
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. The parties submit to the exclusive jurisdiction of the state and federal courts located in San Luis Obispo County, California, except that either party may seek injunctive relief in any court of competent jurisdiction.
Before filing a claim, each party agrees to attempt in good faith to resolve the dispute informally by contacting the other and allowing thirty days to reach a resolution.
